Dutch Regulator Launches Probe Into Player Influence Techniques Used by Online Gambling Operators

Regulator Responds to Concerns About Player Manipulation

The Kansspelautoriteit (KSA), which oversees Dutch gambling, plans to investigate “negative behavioural control” used by online operators to sway players. Authorities indicated that insights gained from this inquiry may lead to tightened regulations aimed at reinforcing the duty of care online providers owe their customers.

Research Reveals Influence Techniques

Before starting its own investigation, the KSA asked Behavioural Insights to study how digital gambling platforms influence player behavior. Findings showed that, similar to other commercial businesses, gambling operators employ behavioral techniques to direct consumer actions. Some interventions are considered beneficial, such as giving players feedback on their gameplay or tools to help them take breaks. However, the research highlighted detrimental practices as well, such as facilitating high-stake bets for newcomers, which may increase risk for individuals struggling with addiction.

KSA Statement on Next Steps

Michel Groothuizen, chairman of the board of the KSA, said: “At the KSA, we understand that online providers, like other commercial companies, look at what users of their platforms do and how they can steer that to their advantage. Thanks to this research, we have a better understanding of how they do this, and we can also give more direction in the area of negative management and things we no longer want to see.

“In response to the results, the KSA will start its own investigation into the negative forms of behavioural control, and the extent to which they conflict with the duty of care of providers. Stricter guidelines may also follow at a later date to limit this negative control.”

Potential Reforms and Political Uncertainty

Possible legislative changes under discussion in the Netherlands include raising the legal age for online casino participation from 18 to 21, as well as mandating financial assessments for players seeking to raise their deposit thresholds beyond limits that have been active since last October. The current caps are set at €300 for players aged 18 to 24, and €700 for those over 24.
